Terms of Service

1. Acceptance of Terms

By accessing or using Sketchpen, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

2. Eligibility

You must be at least 16 years old to use Sketchpen. By creating an account, you confirm that you meet this age requirement.

3. Account Registration

To use Sketchpen, you must create an account with a valid email address, username, and password. You are responsible for maintaining the security of your account credentials. One account per user — sharing accounts is not permitted.

4. Service Description

Sketchpen is an AI-powered platform that generates whiteboard-style explainer videos from text prompts. The service operates on a credit-based system:

• 1 scene rendered = 1 credit (medium quality) or 1.5 credits (high quality)
• 1,000 voice characters = 1 credit
• Credits are allocated based on your subscription plan

5. Subscriptions and Billing

Sketchpen offers monthly subscription plans processed through Razorpay. By subscribing:

• Your subscription will auto-renew each billing cycle
• Pricing is in INR at this time
• Credits reset at the start of each billing cycle and do not roll over
• Plan upgrades take effect at the next billing cycle

Payment is processed by Razorpay. Sketchpen never stores your card details — all payment data is handled securely by Razorpay.

6. Cancellations and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period. All sales are final — no refunds are provided for unused credits or partial billing periods.

7. User Content and Ownership

You retain ownership of the prompts, scripts, and other content you provide to Sketchpen. You also own the videos and other content generated through the service, subject to these terms.

By using Sketchpen, you grant us a limited license to process, store, and serve your content solely for the purpose of providing the service to you.

You are responsible for ensuring that your prompts and generated content are lawful, do not infringe on third-party intellectual property rights, and comply with our Acceptable Use guidelines.

8. AI-Generated Content Disclaimer

Videos generated by Sketchpen are created by artificial intelligence. While we strive for quality, we cannot guarantee the accuracy, completeness, or reliability of AI-generated content. You should review and verify all generated content before using it for commercial or official purposes.

9. Acceptable Use

You agree not to use Sketchpen to:

• Create content that is illegal, harmful, abusive, hateful, or harassing
• Infringe on the intellectual property rights of others
• Generate content intended to deceive, manipulate, or mislead
• Attempt to reverse-engineer, scrape, or exploit the service
• Use automated tools to abuse API rate limits
• Resell or redistribute the service without written permission

10. Service Availability

Sketchpen is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the service at any time.

11. Limitation of Liability

To the fullest extent permitted by law, Sketchpen shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid to Sketchpen in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your account at any time for violations of these terms, without prior notice. You may request account deletion by emailing us at jay@sketchpen.app.

13. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or posted on the site. Continued use of Sketchpen after changes constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nagpur, Maharashtra.
